§ 1 DEFINITIONS

1. Consumer – a consumer within the meaning of the provisions of the Civil Code.
2. Account – a free function of the Store (a service provided electronically), regulated by separate regulations, thanks to which the Buyer can set up his/her own individual account in the Store.
3. Buyer – any entity purchasing in the Store.
4. Privileged Buyer – Consumer or Privileged Entrepreneur.
5. Privileged Entrepreneur – a natural person concluding a contract with the Seller that is directly related to his/her business activity, but is not of a professional nature (definition applicable to contracts concluded from 1 January 2021).
6. Regulations – these regulations.
7. Store – the Qadrmodesty online store operated by the Seller at the Store’s website.
8. Seller – Weniq Julia Ahmed, sole trader, with its registered office at ul. Jodłowa 8b/20,
16-001 Ignatki Osiedle, Poland,

REGON: in the process of being granted.

§ 2 CONTACT WITH THE SELLER

§ 3 TECHNICAL REQUIREMENTS

1. For the proper functioning of the Store, the following are required:
○ a device with Internet access,
○ a web browser supporting JavaScript and cookies.
2. To place an order in the Store, an active e-mail account is also required.

§ 4 SHOPPING IN THE STORE

1. Prices of goods visible in the Store are total prices for the goods.
2. The Seller points out that the total price of the order consists of the price of the goods indicated in the Store and, if applicable, delivery costs.
3. Goods selected for purchase should be added to the shopping cart.
4. The Buyer then selects the delivery method and payment method and provides the data necessary to complete the order.
5. The order is placed when its content is confirmed and the Regulations are accepted by
the Buyer.
6. Placing an order constitutes the conclusion of a sales contract between the Buyer and the Seller.
7. The Seller provides the Privileged Buyer with confirmation of the conclusion of the sales contract on a durable medium at the latest upon delivery of the goods.
8. The Buyer may create an Account or place orders without registration.

§ 5 PAYMENTS

1. The order may be paid using:
○ electronic payment platforms (e.g. Stripe, Przelewy24).
2. If advance payment is chosen, payment must be made within 1 business day of placing the order.
3. Due to the nature of certain payment methods, payment may only be possible
immediately after placing the order.
4. The Store accepts payment cards including Visa and Mastercard.
5. The Seller is not a VAT taxpayer.

6. The Seller provides a 2-year liability for conformity of goods with the contract, in accordance with applicable law.

§ 6 ORDER FULFILLMENT

1. The Seller is obliged to deliver goods free from defects.
2. The order processing time is up to 14 Working Days.
3. In the case of advance payment, the Seller proceeds with order fulfillment after payment is received.
4. Delivery is available in Poland and European Union countries.
5. Goods are delivered via courier companies or parcel lockers, depending on the Buyer’s choice.
6. Orders are shipped from Poland.

§ 7 RIGHT OF WITHDRAWAL FROM THE CONTRACT

1. The Privileged Buyer has the right to withdraw from the contract within 14 days without giving any reason.
2. The withdrawal period expires after 14 days from the date on which:
○ the Buyer took possession of the goods, or
○ a third party indicated by the Buyer took possession of the goods.
3. To exercise the right of withdrawal, the Buyer must inform the Seller by an unequivocal statement (e.g. email).

4. The withdrawal form template may be used but is not mandatory.

EFFECTS OF WITHDRAWAL

1. In the event of withdrawal, the Seller shall refund all payments received, including delivery costs (except additional costs resulting from a non-standard delivery method).
2. Refunds will be made within 14 days using the same payment method.
3. The Seller may withhold the refund until the goods are returned or proof of return is provided.
4. Goods must be returned within 14 days to:

5. The Buyer bears the direct cost of returning the goods.
6. The Buyer is liable only for diminished value resulting from use beyond what is necessary to establish the nature and functioning of the goods.

§ 8 EXCEPTIONS FROM THE RIGHT OF WITHDRAWAL
The right of withdrawal does not apply to contracts for:

● non-prefabricated goods made to the Buyer’s specifications,
● goods that spoil quickly,
● sealed goods opened after delivery for hygiene reasons,
● goods inseparably connected with other items after delivery,
● sealed audio/video recordings or software opened after delivery,
● newspapers, magazines (except subscriptions),

● goods whose price depends on financial market fluctuations.

§ 9 COMPLAINTS

1. Complaints may be submitted under statutory liability for conformity of goods with the contract.
2. Complaints should be submitted to the Seller’s postal or email address.
3. If return of the goods is required, the Privileged Buyer sends them at the Seller’s expense.
4. Complaints are reviewed within 14 days.

OUT-OF-COURT DISPUTE RESOLUTION
The Consumer may use out-of-court dispute resolution methods, including mediation, arbitration courts, consumer ombudsmen, and the ODR platform:

§ 10 PERSONAL DATA

1. The Seller is the controller of personal data.
2. Data are processed in accordance with GDPR.
3. Detailed rules are described in the Privacy Policy available in the Store.
4. The Buyer has the right to access, rectify, erase, restrict processing, transfer data,
object, and lodge a complaint with the President of the Personal Data Protection Office.

§ 11 FINAL PROVISIONS

1. Providing unlawful content is prohibited.
2. Each order constitutes a separate sales contract.
3. Contracts are concluded in Polish.
4. In disputes with a Buyer who is not a Privileged Buyer, the competent court is the court having jurisdiction over the Seller’s registered office.
5. The Regulations are valid from the date of publication.
